ARTICLE
1 - Application and opposability of the General Terms of Sale
Any orders from the customer as well as any deliveries made by Cation
imply full approval, without any reservation, from the buyer of these
general terms of sale, excluding any and all other documents such as folders,
catalogues issued by the seller and that shall possess an indicative value
only.
The cancellation
or non-applicability of one of the clauses under the general terms or
under the special terms shall not entail the cancellation of the other
general or special clauses which shall continue to be fully valid and
applicable.
ARTICLE
2 - Information
The customer declares also that he has been informed comprehensively of
the characteristic features and of the conditions of use regarding the
services and products he is ordering.
ARTICLE
3 - Acceptance of the order
The information provided by the buyer when the order is being accepted
shall be binding on the buyer: in the event of any error in the wording
of the particulars of the recipient, the seller shall not incur any liability
as to the impossibility in which he may find himself of delivering the
product.
Orders shall become
final only after they have been confirmed via settlement of the price
by the buyer. Any change in or cancellation of the order by the buyer
can not be taken into account and the price paid shall not be refunded.
Offers for products
shall be valid within the limits of the stocks available.
ARTICLE
4 - Delivery
Orders
shall be executed from Monday to Friday, except for legal holidays.
Parcels shall be shipped from Belgium within a period of 1-6 workdays
following the receipt of your order, subject to the availability of
stocks.
If you pay by bank transfer, your order will be dispatched within a period
of 1-6 workdays following receipt of your payment.
A detailed invoice
covering your order and drawn up in your name shall be enclosed with your
order.
A contribution
to shipping costs (packaging and freight charges) shall be added to the total amount
of the invoice. See amount below:
STANDARD POSTAL SERVICE:
We shall not accept any responsibility as regards delays
incurred by the postal services. If the post office loose your parcel
we do not return the goods considering this one is not ensured by
the post office.
NOTICE CONCERNING THE FRENCH CUSTOMER:
We do not take any responsibilities concerning the delivery
time made via the post service. For France, the average time
for a parcel containing cleaning products is 3 weeks! In
the event of lost parcel by the post office we do not return the
goods considering this one is not ensured by the post office.
In order to counter these deadlines, we recommend you our
express service with tracking number by Colissimo France.

SERVICE WITH TRACKING NUMBER:
For France, parcels in express service with tracking number are sent
with colissimo france. This service gives also an insurance in the event of loss
or destruction of the parcel. Between the sending and the reception by the customer
the delivery time is +/- 1 week.
For Belgium, parcels in express service with tracking number
are sent with kilopost. Between the sending and the reception by the customer
the delivery time is +/- 3 days.
For the other European countries, we propose you the services
of
company GLS.
GLS is an express delivery carrier specialized in the collection and
the distribution of urgent parcels with follow-ups of the parcel (tracking number).
Restrictions: Deliveries GLS being
done during the office hours and with signature,
we recommend to you to provide us a delivery address where you are
certain to
be
able to take
delivery of the parcel lasting these hours.

services. Any failure to comply with the periods of delivery allowed shall
not entitle to any claims for damages.
Cation shall
decline any responsibility for late deliveries or for non-deliveries
in the event of force majeure or of events beyond its control, which
would make the performance of the agreement impossible or more expensive,
in part or as a whole, or in the event of actions by third parties
such as the suppliers of the parties to this agreement, subcontractors,
agents and representatives or in the event where the customer fails
to comply with his commitments.
As cases of force majeure that release the seller from his obligation to deliver
shall be considered: war, riots, fire, strikes, accidents and the impossibility
of obtaining supplies. The seller shall keep the buyer informed in good time
of any cases or events as enumerated above.
In any event, the
delivery within the periods of time set shall take place only if the buyer
has complied with all of his obligations with regard to the seller.

5 bis - Returns - Procedures
Any return of products shall be subject to a formal agreement between
the seller and the buyer. Any take-back accepted by the seller in the
event of any visible flaw or of non-conformity of the products delivered,
as determined by the seller, shall allow the buyer to obtain the cost-free
replacement thereof or a refund, excluding any other indemnity or claim
for damages.
A copy of the
invoice shall have to accompany your return as well as a message in writing
that indicates the reason for this return. We shall effect the exchange
or the refund within a period of 10 workdays following its receipt. The
costs for the return shall be refunded also in the event of any error

A contribution

about an amicable solution. Otherwise, the Courts of Belgium (Court District
of Nivelles) alone shall have jurisdiction.
